1. Acceptance of Terms

By accessing or using the Blastly platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use our Service. These Terms apply to all users, including businesses and individuals who access Blastly as a Tenant.

2. Description of Service

Blastly is a multi-tenant WhatsApp Business messaging platform that enables businesses to send and manage WhatsApp messages via the Meta WhatsApp Business Platform API. Blastly acts as a Tech Provider and is responsible for the underlying infrastructure and platform.

Blastly is not affiliated with WhatsApp Inc. or Meta Platforms, Inc., though it operates under the Meta WhatsApp Business API Terms of Service.

3. Account Registration

To use our Service, you must:

• Register and create a Tenant account with accurate and complete information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Be at least 18 years old or have legal authority to bind your organization.

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree to use Blastly only for lawful purposes and in accordance with these Terms. You must NOT:

• Send spam, unsolicited messages, or bulk promotional messages without recipient consent.
• Violate Meta's WhatsApp Business Policy or Commerce Policy.
• Use the Service to distribute malware, phishing, or fraudulent content.
• Attempt to reverse-engineer, decompile, or disassemble the platform.
• Resell or sublicense access to the Service without prior written consent from Blastly.
• Use the Service in any way that may disrupt, damage, or impair the platform.

5. WhatsApp Business API Compliance

By using Blastly, you agree to comply with all Meta WhatsApp Business Platform policies, including but not limited to:

• WhatsApp Business Policy
• Meta Platform Terms
• WhatsApp messaging limits and quality rating guidelines.

Blastly reserves the right to suspend or terminate accounts that violate Meta's policies without prior notice.

6. Intellectual Property

The Blastly platform, including its software, design, trademarks, and content, is the exclusive property of Blastly and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes in accordance with these Terms.

7. Fees and Payment

Certain features of the Service may be subject to fees. All applicable fees will be disclosed prior to purchase. You agree to pay all fees in accordance with the pricing and payment terms in effect at the time of purchase. Fees are non-refundable unless otherwise stated.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Blastly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount paid by you in the three (3) months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts in Indonesia.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the new Terms.
